Terms and Conditions
1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and LinkrCap, Product of Lamrik Labs Private Limited ("LinkrCap", "we", "us", "our") regarding your use of the LinkrCap platform, website, and all associated services.
By registering an account, accessing the platform, or using any LinkrCap service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use LinkrCap.
2. Eligibility
- You must be at least 18 years of age
- You must have legal capacity to enter into binding contracts under applicable law
- You must not be barred from using the services under any applicable laws
- If using on behalf of a company, you represent that you are authorized to bind that company to these Terms
We reserve the right to refuse service to anyone for any reason at any time.
3. Account Registration and Security
You agree to: (a) provide accurate, current, and complete registration information; (b) maintain the security of your password and account credentials; (c) promptly notify us of any unauthorized use of your account; and (d) accept responsibility for all activity conducted under your account.
LinkrCap is not liable for any loss arising from unauthorized account access resulting from your failure to maintain credential security.
4. Platform Services
4.1 Services Provided
- AI-powered startup idea validation and scoring
- Personalized execution roadmap generation
- AI-assisted pitch deck creation
- Startup news, insights, and market intelligence
4.2 Service Availability
Services are provided on an 'as is' and 'as available' basis. We do not guarantee uninterrupted availability. We may modify, suspend, or discontinue services at any time with reasonable notice where possible.
5. AI-Generated Content
All content generated through LinkrCap's AI features (validation scores, roadmaps, pitch decks, market analyses, etc.) is produced algorithmically by artificial intelligence models. You expressly acknowledge and agree that:
- AI outputs may be incomplete, inaccurate, outdated, or unsuitable for your specific situation
- AI outputs do NOT constitute professional, financial, legal, investment, or business advice
- AI validation scores are indicative estimates only and do not guarantee business success or investor interest
- LinkrCap makes no representation regarding the accuracy, reliability, or suitability of AI outputs
- You use all AI-generated content entirely at your own risk
- You must independently verify all AI-generated information before relying on it for any decision
- No AI output from LinkrCap should be presented to investors or third parties as professionally validated advice
6. User-Generated Content
6.1 Your Content
You retain ownership of content you create and submit to LinkrCap. By submitting content, you grant LinkrCap a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute your content within the platform solely for the purpose of providing services to you and other users.
6.2 Content Standards
All content you submit must: (a) be accurate and not misleading; (b) not infringe any third-party intellectual property rights; (c) comply with all applicable laws; (d) not be defamatory, obscene, or harmful.
6.3 LinkrCap's Rights
We may remove, modify, or disable access to any content that violates these Terms, without notice and without liability to you.
7. Prohibited Conduct
You agree not to:
- Use the platform for any illegal, fraudulent, or unauthorized purpose
- Create or publish false, misleading, or deceptive content
- Impersonate any person or entity, or misrepresent your affiliation
- Attempt to defraud other users through the platform
- Scrape, copy, or systematically extract platform data
- Use automated tools, bots, or scripts to abuse the system
- Attempt to gain unauthorized access to any part of the platform
- Interfere with or disrupt platform infrastructure or servers
- Reverse engineer, decompile, or disassemble any platform software
- Violate any third party's intellectual property, privacy, or other rights
- Transmit viruses, malware, or other harmful code
- Use the platform to solicit investment funds without proper regulatory compliance
8. Payments and Subscriptions
- Subscription plans are billed in advance on a monthly or annual basis
- Plans automatically renew unless cancelled at least 24 hours before renewal date
- Payments are processed by Razorpay (India) or Stripe (International)
- We do not store card details, CVV, or banking credentials
- AI feature credits reset at the start of each billing cycle
- Unused credits expire at end of billing period and are non-transferable
- GST/taxes applicable at current rates as per Indian tax law will be charged
- Price changes will be communicated at least 30 days in advance
9. Intellectual Property
All intellectual property relating to the LinkrCap platform, including software, algorithms, branding, trademarks, logos, product names, database structure, and platform design, is exclusively owned by LinkrCap or its licensors. Nothing in these Terms grants you any rights in LinkrCap's intellectual property except the limited right to use the platform as permitted herein.
10. Limitation of Liability
To the maximum extent permitted by applicable Indian law, LinkrCap, its directors, officers, employees, agents, and service providers shall NOT be liable for:
- Any loss of profits, revenue, business opportunity, or anticipated savings
- Any loss of data, goodwill, or reputation
- Any indirect, incidental, special, consequential, or punitive damages
- Decisions made in reliance on AI-generated outputs or platform content
- Actions or omissions of investors, mentors, or other users on the platform
- Unauthorized access to or alteration of your data (despite reasonable security measures)
- Failure to achieve funding, investment, or business outcomes
- Content generated by other users
- Service interruptions or technical failures
Where liability cannot be excluded by law, our maximum aggregate liability to you shall not exceed the total fees paid by you to LinkrCap in the 3 months immediately preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless LinkrCap, its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the platform; (b) your content; (c) your violation of these Terms; (d) your violation of any third party rights; or (e) any misrepresentations you make through the platform.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us at legal@linkrcap.com and allow 30 days to resolve the dispute informally.
14.2 Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The seat of arbitration shall be Markapur, Andhra Pradesh, India. The language of arbitration shall be English.
14.3 Class Action Waiver
You agree that any dispute resolution proceedings shall be conducted only on an individual basis and not in a class, consolidated, or representative action.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to the arbitration clause above, you consent to the exclusive jurisdiction of courts located in Markapur, Andhra Pradesh, India for any matters not subject to arbitration.
16. Modifications to Terms
We may update these Terms at any time. Material changes will be notified via email at least 15 days before taking effect. Continued use after the effective date constitutes acceptance. If you do not agree with any update, you must stop using the platform and may request account deletion.
17. Termination
We may suspend or terminate your account immediately, without prior notice, for violations of these Terms or applicable law. You may terminate your account at any time. Upon termination, your right to use the platform ceases immediately, and we will handle your data per our Privacy Policy.
18. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, and any other policies incorporated by reference, constitute the entire agreement between you and LinkrCap regarding the subject matter herein.
